Comment: FOIA And EB5
In a case of first impression, a Regional Center asked a Federal Court for a Restraining Order on USCIS FOIA Operations to prevent USCIS from releasing an EB5 Private Placement Memorandum. The complaint features discussion of the interplay between the Securities Act and the Freedom of Information Act. Since FOIA is of general interest to the immigration bar, this litigation may shed light on the FOIA practices of the USCIS, which could be helpful for future FOIA filings, see complaint here.
