  • Dec 24 - Lawsuit Thrown Out

    Comment: Lawsuit Thrown Out
Politico reports that a federal judge has thrown out a lawsuit claiming that President Obama exceeded his constitutional powers in his executive actions on immigration. The law suit was brought by Arizona Sheriff Joe Arpaio.

In her 33-page ruling Tuesday, Howell concluded that Arpaio's suit failed on several grounds, including showing a "particularized" harm and demonstrating that the judge had the power to redress whatever problems Obama's policy changes were creating for the sheriff. Howell said Arpaio's central argument - that his county was incurring greater costs due to the Obama immigration actions - might well be flawed... Howell accepted the core of the Obama administration arguments for the legality of the executive actions: that they fall within the ambit of prosecutorial discretion...
The Obama administration is facing another lawsuit in federal court in Brownsville, Texas, where 24 states are pursuing a similar legal challenge. Please let us know your thoughts by writing to us at editor@ilw.com

Comment: Change in EB5 Market – its all about marketing

      Old EB5 Model-Seller's Market New EB5 Mondel-Buyer's Market
      Issuers Small number of Issuers
(Project + USCIS approval = investment success)
      Large number of Issuers
(USCIS approval & good project are commodities)
      Market Only China Multiple markets:
      China, India, Vietnam, etc.
      Roles Issuer gets project & USCIS approval;
Chinese Agent does SOF and Sales
      Breakup of functions:
      SOF by US immigration attorneys,
      Marketing by Issuers,
      Sales by agents
(A Good Project and USCIS approval are now commodities due to the large number of Issuers with both)
Marketing Marketing NOT necessary for success
(because market was a seller’s market with more demand than supply)
